Updated testing criteria from the WV Department of Health & Human Resources

The Board of Pharmacy has issued a new emergency rule effective immediately in response to prescriptions being written for chloroquine and hydroxychloroquine in expectation of a patient contracting COVID-19.  The Board is responding to concerns that these prescriptions have caused a shortage of these drugs for patients with lupus, malaria and other FDA-approved conditions. This new rule seeks to ensure that these drugs are available to patients who need them for an approved condition and not COVID-19. Currently, there are NO drugs or vaccines approved by the FDA to treat or prevent COVID-19.

The rule states in pertinent part that no prescription for chloroquine or hydroxychloriquine may be dispensed unless ALL of the following conditions are met:

  1. The prescription bears a written diagnosis from the prescriber consistent with the evidence for its use
  2. The prescription is limited to no more than 30 tablets unless the patient was previously established on the medication prior to the effective date of this rule (which is 3-21-20)
  3. No refills are permitted unless a new prescription is furnished.  This requirement does not apply to patients previously established on the medication  prior to the effective date of this rule.
