Physicians are set to face significant cuts to Medicare reimbursement in 2022 despite the ongoing challenges they already face related to the COVID-19 pandemic. Absent congressional action before the end of the year, most physicians will see a nearly 10% decrease in 2022 payments ( see related infographic). The AAOS is advocating for Congress to use any means necessary to avert all cuts before the end of the year.

Presidential Webinar Discusses Payment Reductions for 2022

In a webinar recorded earlier this week, AAOS President Daniel K. Guy, MD, FAAOS, and AAOS Advocacy Council Chair Douglas W. Lundy, MD, MBA, FAAOS, explain upcoming reductions to Medicare reimbursement and changes to the process for resolving surprise medical bills beginning Jan. 1, 2022.  They discuss how these two major policy changes will impact patient access to musculoskeletal care, what the AAOS has been doing to preserve the value of surgical services, and how members can support these efforts into the next year. Webinar viewers will better understand the sources of the Medicare payment reductions, learn about the new regulations intended to implement the “No Surprises Act”, know AAOS’ position and history of advocacy on both issues, and explore opportunities to help fight the cuts and ensure a fair arbitration process. Comments on Surprise Billing Regulations Almost Finalized

Efforts to ensure that Surprise Billing regulations are executed as intended by Congress are reaching a turning point. The comment period for the Part II Interim Final Rule (see AAOS summary) will close on December 6, after which the Departments of Health and Human Services (HHS), Labor, and Treasury, as well as the Office of Personnel Management (OPM), have until Jan. 1, 2022, to make changes before the rule takes effect. AAOS has been meeting with tri-agency/OPM staff and lawmakers, working in coalitions, and drafting its comments to ensure that the rules protect patients and guarantee that physicians have access to a fair and independent dispute resolution process with payors. Meanwhile, HHS’ Assistant Secretary for Planning and Evaluation Office of Health Policy recently released a report outlining the robust patient protections of the rule. Importantly, the report stresses that the positive protections and the consequent impacts on physicians from the rule are not yet known. Read the report…

House Bill Introduced to Mitigate 2022 Medicare Physician Pay Cuts

On November 19, U.S. Reps. Ami Bera, MD (D-Cal.), and Larry Bucshon, MD (R-Ind.) introduced a bill (H.R. 6020) that would extend a delay of pay cuts to physicians under Medicare through the end of 2022. Congress previously implemented a one-year, 3.75% pay increase for independent physicians in the Fiscal Year 2021 spending law to alleviate cuts to specialists when the Centers for Medicare & Medicaid Services boosted pay for primary care and undervalued specialty services. The increase is set to expire in January. In October, Reps. Bera and Bucshon led a letter to House leadership from more than half the members of the chamber urging action on the issue before the end of the year. AAOS advocated in support of the letter and is encouraging members to join in urging Congress to avert the 2022 Medicare pay cuts. Read the press release… 

 

New Regulation Requires Reporting on Prescription Drug, Health Care Spending

On November 17, the Department of Health and Human Services, together with the Department of Labor and the Department of the Treasury (collectively, the Departments), as well as the Office of Personnel Management released an interim final rule that requires private insurers to report data on prescription drug costs and health care spending to federal agencies. This is required by the Consolidated Appropriations Act, 2021 and is a continuation of price transparency initiatives by regulators. The Departments will issue biennial public reports on prescription drug pricing trends and related out-of-pocket costs starting in 2023. Read the CMS fact sheet…

2021 State Participation Challenge Coming to an End
