AAOS Joins Coalition in Urging for Medicare Payment Reform
On January 23, AAOS joined with physician and non-physician organizations representing over one million clinicians and patients in sending a letter to the 118th Congress emphasizing the need for reform of the Medicare payment system. The letter states that the current system is broken and is causing significant instability for healthcare professionals, threatening patient’s timely access to essential health care services. It also pointed out that year-over-year payment cuts, combined with a paucity of available alternative payment/value-based care models, compounds the difficulties physicians face in managing resources to continue care. Before the end of 2022, Congress mitigated some of the pay cuts but fell short of preventing the full 4.5% reduction to Medicare Physician Fee Schedule payments in 2023. The organizations urged Congress to hold congressional hearings and work with all stakeholders to explore long-term payment solutions to ensure America’s seniors continue to receive access to the high-quality care they deserve. Read the full letter…

FTC Considering Ban on Noncompete Clauses
The Federal Trade Commission (FTC) recently released a proposed rule that would ban the use of non-compete clauses across industries. The proposed rule comes in response to what the Commission is saying is “current economic evidence about the consequences of non-compete clauses.” The FTC believes that the current legal frameworks which govern non-compete clauses are outdated and do not account for newer data which shows a negative impact on the labor market as a whole, including innovation and competition within industry. The proposed rule, if finalized, would also require existing non-compete agreements to be rescinded within 180 days of the final rule. Although the changes are broad, non-compete clauses that impact physicians are included and would be impacted should the rule take effect. With this in mind, AAOS is analyzing the rule and planning to submit formal comments to the agency ahead of the March 20, 2023 deadline. See FTC fact sheet…
