HHS Releases Surprise Billing Final Rule
On August 19, the Departments of Health and Human Services, Labor, and Treasury released a final rule building on the policies set forth in the July 2021 and October 2021 interim final rules on the Requirements Related to Surprise Billing regulation, which was initiated as a result of the passage of the No Surprises Act in December 2020. This rule updates the process for payment determination under the Federal Independent Dispute Resolution (IDR) process, as well as clarifies information about the Qualifying Payment Amount (QPA). Among the major updates is new language that follows congressional intent and mandates that IDR entities must look at all codified additional factors, along with the QPA, when determining an appropriate out-of-network rate to settle disputes between physicians and insurers. CMS Prepares a Roadmap for the End of the COVID-19 Public Health Emergency
The Centers for Medicare & Medicaid Services (CMS) published a blog on August 18 sharing framework in preparation for the end of the COVID-19 Public Health Emergency (PHE). While some of the measures put in place in response to COVID-19 to ensure access to care will remain in place after the PHE, the Agency has identified those that are no longer needed at this stage of the pandemic. With this, CMS has created a roadmap for the eventual end of the Medicare PHE waivers and flexibilities and is sharing more information on what providers can do to prepare. Specifically, CMS has released provider-specific fact sheets with information about which waivers and flexibilities have already been terminated, those that are permanent and those that will discontinue at the end of the PHE.
