Affordable Care Act Ruled Unconstitutional in Texas Court

On December 14, a federal judge in Texas struck down the Affordable Care Act (ACA) as unconstitutional. The surprise ruling puts the entirety of the health care law in jeopardy, though it has been met with skepticism by experts on the left and the right. A coalition of Democratic state attorneys general defending the ACA will appeal the ruling, so it will have no immediate effect on the nation’s health care system.

If upheld through the appeals process, the decision would eliminate not only the individual mandate—the section challenged in this case—but also the provisions that created the Center for Medicare and Medicaid Innovation (CMMI). This would be problematic as the center established an approval process for biosimilar drugs and numerous others.
